Rep. Steve King (R-IA) introduced a bill last Thursday that would stop children, who are born in the United States to undocumented parents, from gaining U.S. citizenship.
Rep. King's bill would “clarify those classes of individuals born in the United States who are nationals and citizens of the United States at birth,” reports ThinkProgress.org.
However, the 14th Amendment in the U.S. Constitution says: “[all] persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”
The “jurisdiction” part refers to people who are under American law, but would not apply to foreign diplomats and their families, who are granted immunity from U.S. law and are not entitled to citizenship under the 14th Amendment.
The Supreme Court has repeatedly ruled that anyone born in the United States should receive citizenship under the 14th Amendment.
