Rep. Peter King (R-New York) claimed last night that Eric Garner was responsible for his own death due to his physical health.
“If he had not had asthma, and a heart condition, and was so obese, he would not have died from this,” Rep. King told CNN (video below).
According to CNN, a coroner ruled that Garner's death was a homicide, which means he was killed by another person.
The New York Times reports that several conservatives have said that the NYPD used excessive force on Garner.
Rep. King admitted the NYPD doesn't allow chokeholds, but said that NYPD Officer Daniel Pantaleo's chokehold on Garner was not illegal.
"In this case, a chokehold was not illegal," claimed Rep. King. "It is against department regulations, but as you look carefully, I don't think it was an intent to put him in a chokehold, because [the officer] does move the baton as he brings him down."
Rep. King went on Twitter to applaud the Staten Island grand jury for not indicting Officer Pantaleo and to offer "compassion" for Garner's family:
