Police: Lindsay Lohan Violated Her Probation

Police believe actress Lindsay Lohan violated her probation and want her charged with battery over a recent skirmish with a worker at the California rehab center where she spent three months in treatment.

Police in Riverside, California, east of Los Angeles, said in a statement that the case against the “Mean Girls” actress should be pursued even though the victim, Betty Ford Center staff member Dawn Holland, wants it dropped. If a judge determines Lohan violated her probation, she could be sent to jail.

The decision by police came as Lohan completed her court-ordered rehab at the drug and alcohol treatment center on Monday amid conflicting reports over when or whether she had left the facility near Palm Springs, California.

Lohan, 24, has not been seen and has remained silent since sending a Twitter message on Jan 1, saying “Today is the first day of the rest of my life.”

Her stay at Betty Ford was her fifth stint in rehab in three years and came after she failed a random drug test while on probation for a 2007 drunk driving and drug conviction.

Lohan is accused of pushing Holland on December 12 and snatching a telephone from the hand of Holland, who had been called to perform an alcohol breath test on the actress.

Initially, Holland complained to police and wanted to press charges against Lohan, but she has since said she does not want charges filed. Riverside police, however, declined to close the case and said late on Monday they would forward it to prosecutors who will determine whether to file formal charges.

“The investigation determined Ms. Lohan violated several aspects of her probation, including the battery,” police said in a statement.

The troubled actress is due back in court in Beverly Hills for a progress hearing in February. She has already been jailed three times on the drunk driving charge, once initially in 2007 and twice more in 2010 for violating probation.
