A 30-year-old man accused of forcing a woman to jump from his 14th floor apartment balcony went on trial for murder Oct. 10.
Gable Tostee was charged with the murder of 26-year-old tourist Warriena Wright, who was found dead at the base of his apartment building Aug. 8, 2014, the Daily Mail reported.
The pair met on the dating app Tinder and reportedly spent the night drinking together.
At around 2 a.m., according to neighbors, Tostee and Wright could be heard banging furniture around.
Tostee made an audio recording on his phone, in which they could first be heard chatting before an argument broke out.
Wright was heard hitting Tostee, who then responded, “That’s enough,” according to ABC Online.
After failing to find her phone, Wright was then heard to say, “I will f***ing destroy your jaw. It's not f***ing funny.”
Tostee responded by accusing Wright of beating him up.
“You're lucky I haven't chucked you off my balcony you God damn psycho bitch,” Tostee said in the recording, the Mail reported.
Wright allegedly threw some decorative rocks at Tostee, which annoyed him.
“You're not going to collect any belongings, you're just going to walk out,” he added.
“If you try to pull anything I'll knock you out, I'll knock you the f*** out -- do you understand?” said Tostee.
Tostee forced Wright onto the balcony and then locked a glass door back into the apartment.
Prosecutor Glenn Cash said in court that he would argue that Tostee, through threats and intimidation, made Wright feel that the only way to escape the apartment was to climb down the balcony. Defense attorney Saul Holt disagreed, arguing that Tostee was a real person and not a “cartoonish villain.”
Holt went on to allege that Wright became aggressive and that Tostee had a right to defend his property. He denied the prosecution's allegation that Tostee choked Wright.
The court also heard on the opening day of the trial from Wright’s sister, Marreza, who said she had exchanged Facebook messages with her sister on the night she died.
Another witness was a neighbor who reported hearing Wright say “No, no, no, please let me go home.” Around 15 seconds later, the neighbor witnessed Wright fall from the balcony.
Tostee pleaded not guilty to the murder charge. The trial is expected to last seven or eight days.
