Texas High School Student Suspended Despite Negative Drug Test Results

A Texas high school student was suspended despite her solid academics and negative drug test.

Hailey Gibbons, a sophomore at Klein Collins High, in Klein, Texas, was suspended for "acting odd," although there was no sign of drugs in her system.

Gibbons was late to a class one day, so went to the school office. An assistant principal, someone Gibbons had allegedly never met before, claimed the teenager was acting strangely. She was made to take a field sobriety test, which was administered by a school nurse.

"I would say I am not on drugs and they would say, 'You are, just give it up, you are,'" Gibbons told Fox 26 Houston. "I started breaking down."

The 16-year-old has a clean record, good grades and insisted that she was sober numerous times.

"If they would have known me they would have known that I would not be on any type of drugs and the fact that they kept accusing me over and over again, when they just don't know anything," Gibbons explained.

Jennifer Saxton, Gibbon's mother, took the teenager to Quest Diagnostics for a drug test. The 11-panel exam came back completely negative.

With the drug test results in hand, they figured the problem would be quickly remedied. Unfortunately, the school reportedly ignored the drug test results in favor of a school nurse's opinion. Gibbons was sentenced to 30 days in alternative school.

"They are more worried about being right than doing what's right," stated Saxton.

"Now you have a student with proof, scientific evidence that she was not taking drugs," said Gibbon's lawyer, Chris Tritico. "The school district says, 'we don't care about that, you're gone anyway,' and they label this child a drug abuser in her permanent school record. It's wrong, and it's a civil rights violation."

"Her reputation, her school record, it affects everything," Saxton explained, in tears.

On the Fox 26 Houston Facebook page, numerous people expressed outrage.

"Normally I'm against over suing over any little thing but in this case this parent needs to take them all to the cleaners," one commenter said. "They've jeopardized her entire future over nothing."
