Philadelphia Spa Worker Jennifer Finley Fired After Refusing Brazilian Wax

Pittsburgh woman Jennifer Finley was fired after refusing a Brazilian wax treatment as part of her salon training, and his since filed a lawsuit against her former employer European Wax Center.

“No woman should be forced to have a Brazilian wax against her will and certainly no one should be fired for refusing to have one,” Finley said.

After privately building her clientele, Finley was told she would have to perform the wax on her colleagues and vice versa. When Finley declined, uncomfortable with exposing herself to her coworkers and anticipating sensitivity from menstruation, she was told to "pop a fresh tampon [and] take some ibuprofen”.

Finley was then referred to the spa owner and terminated.

According to the suit, which Finley filed at the Equal Employment Opportunity Commission just weeks after her termination, the spa subjected Finley and some of her female colleagues to “humiliating, painful, embarrassing, and discriminatory” procedures. Vincent Mersich, Finley’s lawyer, accused the spa wrongful termination and gender discrimination, considering only women were asked to endure the waxing.

"It's the sort of thing we don't think an employer should have the ability to control with respect to their employees," Mersich said. "They can't expect them to be comfortable exposing their anus and genitalia to coworkers ... or to perform that waxing on their coworkers.”

Finley earned $8 an hour at the spa, only 75 cents over Pennsylvania’s minimum wage, plus a small commission.
