A New York man was found guilty of killing a 17-month-old baby, but he’ll likely only spend a few months in jail for the crime.
Back in March of 2011, Kysheen Oliver killed his girlfriend’s foster son Kymel Oram while babysitting the child. Oliver was reportedly angry because Oram soiled a bed and proceeded to beat the baby. Oliver claims he momentarily “snapped” and hit the bed, but he thought nothing was wrong when he put him in front of the television to watch a program. Suddenly, Oram became unresponsive and started to vomit.
Oliver, who was 19 years old at the time of the incident, was eventually arrested and charged with a number of different crimes for the baby’s death. Ultimately, a jury recently found the 23-year-old guilty of manslaughter for recklessly killing the baby, but he was cleared of all other serious charges, including murder.
Jury members said that contradicting testimony lead them to the decision that Oliver didn’t intentionally kill the baby. He now faces five to 15 years in prison, but because he’s spent three and a half years in jail already, he will be eligible for parole in a little bit over a year. If he had been convicted of murder, he could potentially have spent 25 years to life behind bars.
“No matter what, everyone lost,” said one of the jurors, according to the NY Daily News. “It’s heartbreaking.”
