In Naples, Florida, Mark Abaire was arrested and jailed on felony charges, last week, after refusing to pay for a cup of soda at a McDonald's restaurant.
The Naples Daily News reports that Abaire had asked for a cup of water, but then filled it with soda from the fountain machine.
Abaire was sitting outside the restaurant when the McDonald's manager walked up and asked him to pay a dollar for the soda.
Abaire refused, then would not leave the premises. The McDonald's manager then called the police, who arrived and arrested Abaire.
Abaire was charged with petty theft, but it was increased to a felony because he has previous petty theft convictions. In Florida, a third-degree felony can result in a sentence of up to five years and a $5,000 fine.
