Emilio Chavez allegedly caught a naked prowler, Dylan Maho, peeping into his young daughter's room in their Albuquerque, New Mexico home.
Maho was making noises near the little girl's window at 2:30 a.m. last Thursday, reported KOAT.
Chavez allegedly beat the peeping tom so badly that he was taken to the hospital (video below).
Now, both men are facing felony charges, but if convicted, Chavez could get the longer prison sentence.
Chavez was initially set free after questioning by police, but is now charged with aggravated battery, which is a third degree felony. That means he could face up to three years in jail.
Maho, who is still in the hospital, will be formally charged with felony voyeurism, a fourth degree felony, which can mean between one and two years in jail.
Chavez told KRQE that he was so angry that night of the incident that he doesn't recall assaulting Maho.
Even though neighbors and family members have sided with Chavez, the police say it is not a clear-cut case.
“We have a lot of concerns when victims provoke any kinds of attacks or pursue their attackers even if it’s with good reason, for instance in this situation where you have your children being victimized,” said Albuquerque Police Officer Tasia Martinez.
