A man accused of sexually assaulting a 13-year-old girl in Hutto, Texas, is sitting behind bars after the girl’s father says he caught them in the act.
Deandry Drevon Gault, 20, reportedly talked to the girl on the messaging app Kik and the social media app Snapchat. The girl would borrow her mother’s cellphone to chat with Gault.
According to the police affidavit, officers received a call from the girl’s mother reporting the sexual assault on the morning of July 14. She said her husband woke up at 4:30 a.m. to check the house and found Gault having sex with his daughter. Gault jumped out of the window when the father yelled at him, leaving behind his clothes and car keys.
Gault reportedly returned to the house wearing a blanket to ask for his clothes. He said he thought the girl was 18 and that he was sorry. He reportedly asked them not to tell his parents or call the police.
Gault told police the two met at a college party at a University of Texas dorm, and that she had told him that she was 18 years old.
The girl said she and Gault had sex "four to five times" since May, averaging about once a week, reports KXAN.
The girl allegedly told Gault she was 14, Statesman reports.
When investigators asked Gault to see his phone so they could substantiate the claim that she lied about her age, he refused.
“Either way it goes, I’m going to jail, so I’d rather just go to jail,” he said, reports KXAN.
Gault at one point expressed concern that he and the girl may be cousins, but the girl later found out they were not. The parents apparently know Gault.
Gault was charged with aggravated sexual assault, a first-degree felony, on July 28.
