Cody C. Smith, 40, is a former Utah police officer who is now facing life in prison for forcing a teenage girl to have sex with several teenage boys over the course of several years, starting when the girl was 13-years-old.
Raw Story reports that Smith changed his plea to no contest on Monday to two counts of aggravated sexual abuse of a child.
District Judge Brian Cannell denied Smith’s request to be released so that he may “get his affairs in order,” ordering him to be taken into custody immediately due to the nature of his crime.
Smith took a 13-year-old girl to his home and forced her to “go upstairs and start to undress, kiss and have sex” with the boy. Smith entered the room giving them instructions and forced them to have sex. This happened six times through 2012. Smith also forced the girl to have sexual relations with three other boys between January 2013 and February 2014.
According to Daily Mail, one of the boys reportedly had sex because he felt it was the only way to get out of the apartment. Reports claim that Smith also choked the girl unconscious on several occasions and told one of the boys to get the girl pregnant.
“It is hard to overcome a case in which there is a parade of witnesses who do not know each other, all saying the same thing,” said defense attorney Susanne Gustin. “Cody did not want to put any more victims through the trauma of testifying. He made the right choice for himself and for the victims.”
Smith originally faced ten felony charges including rape, object rape, forcible sexual abuse and aggravated sexual assault.
Smith’s defense team will fight to have his sentences be served concurrently as opposed to consecutively.
