Utah Teacher Charged With Rape And Sodomy For Sex With Teenage Student

A 34-year-old Utah teacher is facing rape and sodomy charges after having sex with a 16-year-old student multiple times last year.

Brianne Altice was arrested and charged with three counts of first-degree felony rape and one count of first-degree felony forcible sodomy after it was discovered that she had sex with the 16-year-old on multiple occasions. Her lawyers tried to convince the judge to throw out the charges, and in their plea, they accused the teenager of being the aggressor.

"She repeatedly refused and declined his advances until he ultimately broke down her resistance," wrote Altice’s lawyer Edward Brass in the motion. "The state failed to establish probable cause to believe that the intercourse that occurred was without consent."

Ultimately, after hearing arguments from both sides, Judge Thomas Kay decided to dismiss the motion to throw out the rape and sodomy charges, and now, Altice is facing all four counts.

“Anytime a story surfaces like this, I think it all causes us concern because these are members of the community that are held to a higher standard,” said school district spokesman Chris Williams to Deseret News.

Altice was initially arrested back in October, and as of February, she was officially fired from her job. She was released on $10,000 bail and is currently scheduled to appear in court in August. The actual trial is not set to start until September, and reports claim that Altice’s husband recently filed for divorce and for custody of the couple’s child.
