David Barajas Charged with Shooting Suspected Drunk Driver Who Killed His Sons

David Barajas and his sons, 12-year-old David Jr. and 11-year-old Caleb, were about 50 yards from their Houston-area home helping push their family’s broken-down pickup truck when a suspected drunk driver slammed into them with his car. David Jr. died at the scene and Caleb died later while being treated at a hospital. Barajas' wife, Cindy, was in the truck when it was hit, along with the couple's 8-year-old daughter and three-month-old son.

According to The Huffington Post, the man who was driving the car, 20-year-old Jose Banda driver, was eventually found shot in the head. Neighbors reported that they heard gunshots in the minutes after the crash and Banda’s death was ruled a homicide.

Barajas, 31, has since been charged with murder in the fatal shooting.

In the moments after the crash, witnesses said they saw Barajas walk to his home and then later approach Banda’s vehicle. Brazoria County sheriff's investigator Dominick Sanders said that evidence showed a single gunshot was fired.

“Every time we would pursue a lead, it always came back to Mr. Barajas,” Sanders said. “We have numerous statements placing him there at the car in close proximity to the victim at the time the gunshot was fired.”

Authorities searched Barajas' home and found ammunition that is consistent with the bullet that killed Banda. However, they have not yet been able to locate the weapon that was used in the shooting, a detail that could make proving Barajas’ guilt a bit tricky.

“The case is going to be much more difficult if we don't have a weapon,” Sanders said.

David Barajas' brother, Gabriel Barajas, has said that his sibling’s memory of the crash is blurry. He also said that speculation that his brother or another family member might have been responsible for Banda's murder "ugly."

Barajas turned himself in on Sunday. As of Monday, he was being held at the Brazoria County Jail on a $450,000 bond.
