A jury in England has cleared a man of rape after he had sex with a woman who was asleep and then posted video of it online.

Stephen Brawn confessed to police that he did have sex with the woman and uploaded video of the act to his Facebook page, but claimed the woman had agreed to allow him to have sex with her sleeping body and to record the intercourse so she could watch it later, according to Gawker.

However, the woman claimed she never consented to either the sex or the recording and certainly not to having the footage posted on Brawn’s Facebook page.

Mail Online reports that the woman said she only found out about the video clip when a relative noticed that the 22-year-old Brawn had uploaded it on to his Facebook page in late May.

The jury, which was made up of eight women and four men, took an hour deliberating the facts of the case before returning a unanimous not guilty verdict, following the two-day trial at Ipswich Crown Court.

Brawn had said that he and the woman had been exchanged intimate photographs on their mobile phones and he had also filmed her performing a sex act on him.

The judge in the case had previously reminded the jury to focus on the rape allegations and not the fact that Brawn has posted the footage on the social media site.

“He is charged with rape and you won’t convict him simply because he put footage of the act on Facebook,” stated Judge John Devaux.

Following the verdict, Brawn shared some thoughts on the investigation with Mail Online.

“This case should never have gone to court if the police had done their job properly.

“They should have looked at this woman’s other mobile phone which would have shown we had been swapping intimate pictures of each other.”
