Johnny Mount allegedly shot and killed a Waffle House waitress in Biloxi, Mississippi, at around 1 a.m. on Nov. 27 (video below).

The 52-year-old waitress told Mount that he was not allowed to smoke inside the restaurant, Biloxi Police Sgt. Donnie Hobbs told the SunHerald.

Mount allegedly pulled a 9 mm handgun from underneath his shirt, and shot the waitress, identified only as "Julie," in the head, police told WLOX.

Julie was rushed to a local hospital, but did not survive the head wound.

Mount was arrested at the Waffle House, and booked for first-degree murder, Dobbs said.

Mount is being held at the Harrison County Adult Detention Center where his bail has been set at $2 million.

Some questioned why the Waffle House re-opened only hours after the shooting. The store didn't explain the fast turnaround, but did say that it is offering free counseling to employees.
