Renee Chaires was accidentally shot and killed last Saturday night while she attended a birthday party for herself and her daughter in Tallahassee, Fla.

The party was held at her brother Eric Stayton's house.

"During this gathering there had been an accidental discharge of a firearm which resulted in, ultimately, the death of one of the persons there at the cookout," Leon County Sheriff's Office Spokesperson James McQuaig told WCTV.

According to the sheriff's report, Stayton twirled a handgun in an attempt to duplicate a scene from the movie "Tombstone," noted the Tallahassee Democrat.

However, Stayton when tried to re-holster the firearm it hit the floor and fired a bullet into Chaires' neck.

Chaires was taken to a local hospital where she died from her wound.

Stayton has not been charged with any crimes, but the Leon County Sheriff's Office is still investigating the incident.
