James Robertson, a 31-year-old father, was arrested by police Sept. 28 for allegedly leaving his children at home unsupervised while he was at work.

A Department of Social Services (DSS) agent visited the home in Spartanburg County, South Carolina, on Sept. 28, FOX Carolina reports.

A 10-year-old answered the door and told the agent that there were four other children -- ages 3, 4, 7, and 9 -- in the house; the child added that while their mother was not home, their father was asleep, according to investigative reports cited by FOX Carolina. The child refused to wake the father, however, and it later emerged that Robertson was not at home.

DSS called the police around 3 p.m., and deputies arrived at the scene. During the visit, a sixth child, 11 years old, arrived home on the school bus.

Both parents then returned, and the mother told police she had left the 3-year-old and 10-year-old in the care of Robertson when she went to work earlier that morning.

Robertson acknowledged leaving two children, the 10-year-old and 3-year-old, alone, saying that he had been called in to work just before noon. He added that the other children returned from school while he was gone.

Robertson was charged with one count of cruelty to children. He was released from custody early Sept. 29.
