Delhi Charter School Policy Would Kick Pregnant Teens out of School

In Delhi, Louisiana, the American Civil Liberties Union and the ACLU of Louisiana, on Monday, warned the Delhi Charter School that its teen pregnancy policy violated federal laws and the U.S. Constitution.

Delhi Charter School claims it has the right to require any female student to take a pregnancy test, if the administration suspects she is pregnant.

Girls who test positive, or refuse the test, are not allowed to attend classes on campus. Instead, they must complete a home study course or withdraw from the school.

In a letter to the Delhi Charter School, the ACLU said the school policy violates Title IX of the Education Amendments of 1972, and the Equal Protection Clause and the Due Process Clauses of the U.S. constitution.

Title IX prohibits public schools from excluding a female student from class because she is pregnant.

Almost every comment here is irrelevant to the question - the last line in the article summed up the whole issue - "Title IX prohibits public schools from excluding a female student from class because she is pregnant" - so the issue will be, is a charter school a "public" school, or not? (There is truly no such thing as a public school; what we have are government schools, but that's another discussion altogether).

What is the benefit to anybody in expelling girls who get pregnant? I can't see how the school, or city, or state, or country, or especially the girl, will benefit in any way if these girls are expelled? Is there some benefit we get by making sure young mothers are uneducated as well? How are these girls going to support themselves and their child without even a high school education?

Actually, I think I just figured it out. These charter schools are known for cherry picking their students so they only have the "best and the brightest" that way their performance numbers look good. I bet they are assuming that if a girl gets pregnant she's going to have to re-prioritize and her grades will go down bringing down their overall test scores. So, rather than try to be flexible and educate the kids as they're supposed to do it's easier to kick them out.

It's just a theory, but it makes sense.

That's stupid. So if you get pregnant we want you to remain uneducated too. So what is an uneducated, pregnant teen supposed to do? Go on welfare? If the Delhi Charter School is so into education and clear thinking, why don't they try it themselves?

Ah, yes - promiscuity is alive and well in the moral decay of the United States. Can't these girls keep their legs closed? Where are their Mothers? In my state, we have at least one baby, belonging to an unwed mother, MURDERED weekly - this week is an 11 month old boy beaten by the 'boyfriend'.....the baby was beaten so hard, his diaphragm separated from his spine, lower back was broken, face/head were black and blue from being punched with a fist.

There is so little sanctity when it comes having a baby - some women (and girls) are brood mares.

Then the irresponsible, immature guys that make them pregnant are in no way at fault? It isn't "Moral decay" at all. There have always been teen-age and unwed pregnancies. The real problem is the religious reich denying proper education in contraception and general knowledge of the consequences and responsibilities of sex.

But all totalitarian organizations, governments, religions, or social groups must first control the sex lives of everyone. After someone accepts that they can be told when, how, and with whom they can have sex, controlling the rest is easy.

Of course it's equal responsibility, that really goes without saying....and I beg to differ w/you - if it isn't moral decay what would you call it? It's rampant in this country - check out the statistics.

And provide statistics for how many of these girls have a religious background......the ACLU/government has kicked Him out of schools and much of the country and it will continue.

CONTROL the sex lives of everyone (anyone)? Are you insane? Are you also into sterilization of women? Or like Hitler, wanting to mastermind an Arian 'race' of blue eyed blonds.

Today, an unwed, pregnant teenager doesn't even get a raised eyebrow......and nobody thinks about the baby.

I would like people to go

I would like people to go look up the song "What it's like" by Everlast. It has a really good verse that goes "Mary got pregnant from a kid named Tom, who said he was in love. He said "don't worry 'bout a thing baby girl, I'm the man you've been dreaming of." Three months later he say he wont date her or return her calls. So she swears "godd*mn ever find that man, cuttin' off his balls." So she heads to the clinic, and she gets some static walkin' through the door. Yeah they call her a killer, and they call her a sinner and they call her a whore. But God forbid you ever have to walk a mile in her shoes, 'cause then you really might know what it's like to have to choose."

It takes two to make a child. Calling the woman a "brood mare" is derogatory, and you seem to forget about the guy involved. Moral decay is in it I'm sure, but the real problem here is cultural. It isn't just a matter of girls "keeping their legs closed", it's also a matter of parents not educating their children, teaching self respect etc. But also not teaching them that guys tend to lie to get laid.

I'm aware boys/males are

I'm aware boys/males are involved; this is the 21st Century - there isn't a high school girl alive who does not know or isn't aware of a female peer who is/was pregnant and the ramifications of being so, so naievete doesn't even play a role. Did she skip sex-ed in school? It's a known fact that most parents for embarrassment or out of ignorance do not broach the subject w/their children.. The pregnant teen saga is on television talk show, court programs, in movies, magazines....a new show on TV is "I'm Having Your Baby"....."Studly" evidently dumps them all - and she knows that, too. I don't feel a bit sorry for her - I do feel sorry for the innocent baby she will bring into the world (hopefully).

The self-esteem, lying issue is ages old - and these girls are 21st century beings - they've heard it all, know it all.

Rape/incest aren't even in the equation - something over which she had no control.

Even though it is technically a private school, don't they receive public money in the form of vouchers when students transfer from public schools to charter schools? But this is Louisiana, so maybe they are not that far advanced?

This is a public school, private schools can expel pregnant students and do depending on their policies. Money can probably fix it.

Thanks for the update. In the states where I lived, charter schools were considered private schools. As a public school, they are subject to the same laws as anything else receiving public money.

As for the private schools, you're right, money can probably fix it. If you have enough money, very little of what affects anyone else applies to you.

What right does the school have to order a minor student to undergo a medical test without parental permission, for that matter?

Has Louisiana just decided to pull out all the stops and make being female grounds for termination of all constitutional and human rights?

Haven't you heard? It's only unacceptable government intrusion if it's done by liberals. If a liberal wants to keep someone from dumping poison in your drinking water that's an unconstitutional intrusion on their god given rights. On the other hand conservatives can regulate you right down to your internal organs and that's just good Constitutional sense. Remember, for spending, regulation, cheating on your spouse or anything else, IOKIYAR. (It's OK if you're a Republican)
