A San Antonio, Texas, man is facing charges after his girlfriend’s 12-year-old daughter was discovered to be pregnant and reported abuse during a visit to the hospital.

Tommy Guerrero, 41, is being held on charges of continuous sexual abuse of a child with bail set at $100,000. Guerrero is also held on unrelated charges for possession of a controlled substance, reports Chron.

The girl went to the hospital for treatment of a headache and vomiting, symptoms of what was assumed to be meningitis, according to an affidavit for Guerrero’s arrest warrant. It was then discovered during an evaluation the girl was pregnant.

The girl tearfully told a sexual assault examiner in an interview that she was assaulted by a man who was nicknamed “Smiley,” and that she had been abused about nine times in three years.

Guerrero, or "Smiley," who is the boyfriend of the girl’s mother, would visit the family at their home. That was when the assaults would occur, the victim said.

The warrant states that the victim tried to fight Guerrero off at the times of the alleged assaults, but Guerrero overpowered her.
