A North Carolina teacher who allegedly had sex with one of her students will not face jail time.
Summer Sparrow, 41, who was accused of having sex with a 17-year-old student, gave up her teaching license in a deferred prosecution, according to The Charlotte Observer. Under the arrangement, Sparrow will not be allowed at any Gaston County School, or event where students will gather, for one year.
If Sparrow stays away from the schools and students for a year, her charges may be dismissed, and she could petition the court to expunge them. If she does not follow the conditions of the arrangement, she could face 16 to 29 months in prison.
In a deferred prosecution arrangement, a defendant will not serve prison time as long as he or she fulfills the conditions of the arrangement, according to the Shelby Star. The defendant in a deferred prosecution arrangement admits he or she has done something wrong.

Sparrow was arrested in 2016 after the student told authorities the pair had sex in Sparrow's home, reports WGHP. Sparrow, a former English teacher at Cherryville High School, allegedly talked to the student on Snapchat daily before the communications became flirtatious.
Police said Sparrow invited the teen to her home, where the two had sex. She reportedly picked the student up at a car wash after dropping her teenage daughter off at a party. After their encounter, she dropped him off at a pizza restaurant, telling him not to talk about what had happened, the Daily Mail reports.
According to search warrants in the case, the 17-year-old took a nude photo of Sparrow, which he shared with friends on Snapchat.
Sparrow was charged with sexual activity with a child. When the teen and his parents came forward to police, he was able to describe the layout of Sparrow's home, and told authorities about the nude photo.

Sparrow, a mother of two, was reportedly in a relationship with 27-year-old Alan Cobb when she allegedly had sex with the teen.
Sparrow, who is now going by a different name, calls herself "Dirty Bird" on social media.
"Today was a tough day for her," said Sparrow's attorney, Travis Page. "She gave up a profession that she thoroughly enjoyed, a profession that she excelled at, so obviously today was a somber occasion for her."
"She's with her family, and so that's all she can ask for right now is to be comforted by her family and friends," Page said, adding that Sparrow feels regret for what happened.
