Prosecutors To Seek Death Penalty For Mother And Boyfriend Who Tortured, Killed 8-Year-Old Son

Prosecutors are reportedly seeking the death penalty for a mother and her boyfriend, both of whom were charged with torturing and killing the woman’s 8-year-old son.

Pearl Fernandez and her boyfriend, Isauro Aguirre, were indicted by a grand jury on a murder charge and a special circumstance of torture following the May 2013 death of Fernandez’s son, Gabriel. 

Two days before his death, the young boy was allegedly beaten by his mother and Aguirre because he didn’t pick up his toys. He suddenly became unresponsive after the beating, prompting his mother to call 911. When paramedics arrived, they found the child naked and unresponsive in a bedroom with three broken ribs, a cracked skull and BB pellets in his lung and groin. He later died from his injuries.

“It was just like every inch of this child had been abused," Los Angeles County Fire Department paramedic James Cermak said. 

Upon investigation it was discovered that a number of agencies had previously investigated alleged abuse in the home stemming from history of reported incidents, though the boy was never removed from his mother’s custody. 

Both Fernandez and Aguirre reportedly pleaded not guilty.
