Pictures have been found on a cellphone showing two girls face down and partially naked on the floor of a basement in a house in Steubenville, Ohio where another rape of a 16-year-old girl allegedly took place.
The photographs were found on a cellphone of an unidentified friend of Ma’lik Richmond and Trent Mays, the two young men accused of raping the 16-year-old girl, reports the Daily Mail.
The pictures were not taken on the night of the rape, and it is not clear if the girls were conscious or even aware of being photographed.
The unidentified friend was present in August 2012 when the 16-year-old girl was allegedly raped.
The friend gave testimony at the probable cause hearing in October 2012.
The existence of the photographs emerged after the friend repeatedly denied all knowledge of them in spite of the pictures being on his phone.
Walter Madison, Richmond’s attorney, questioned the friend in the probable cause hearing: "There is a photograph here of a woman on the same carpet as the carpet in [the] basement. Do you recall that photo on your phone?"
The friend replied: "No sir. I have never seen those pictures in my life." However, the friend could not explain why the pictures were on his cell phone.
The pictures are very similar to a picture taken in August 2012 of the 16-year-old rape victim stripped naked and lying face down on the same basement floor.
Mays and Richmond will go to trial on February 13. Richmond is charged with rape, while Mays is charged with rape and disseminating photographs of a nude minor.
