A New Mexico judge has thrown out a request to dismiss incest charges against a mother and son who claim to have fallen in love with each other.
The Daily Mail reports that the couple’s defense attorney argued that the recent Supreme Court rulings on same sex marriage and abortion set a precedent which meant that charges should be dropped, but judge Drew Tatum disagreed.
That means that 36-year-old Monica Mares and her 19-year-old son, Caleb Peterson, will face incest charges.
Mares is a mother of nine from Clovis, New Mexico, who gave birth to Peterson when she was 16. Peterson was then adopted, and she saw him for the first time in 18 years when he came to visit her. The pair claim they began a sexual relationship with each other and fell in love, saying "it was almost love at first sight."

They now face up to 18 months in prison and are asking the public to donate to their legal fund.
They are also trying to raise awareness for Genetic Sexual Attraction (GSA), which they claim is the reason behind their relationship. According to The Daily Telegraph, GSA is on the rise, given that it occurs in situations when family members see each other for the first time after long periods have passed. And with the rise of fertility treatments and teen pregnancy and adoption, this will naturally lead to more and more genetic relations meeting for the first time as adults, and thus more instances of GSA.
The bond between Mares and Peterson is so strong, they claim, that they are willing to risk everything to be together. Mares has even stated that she is willing to give up the right to her other children just to be with Peterson.
“He is the love of my life and I don't want to lose him. My kids love him, my whole family does. Nothing can come between us not courts, or jail, nothing. I have to be with him. When I get out of prison I will move out of Clovis to a state that allows us to be together.”

Unfortunately for Mares, incest is a crime in all 50 states, although the punishment varies state by state.
The couple is banned from having any contact with each other as they await trial.
