Man Who Raped 11-Year-Old, Impregnated Her, Sentenced To 35 Years In Prison

A Salinas, California, man has been sentenced to 35 years in prison for repeatedly sexually assaulting his girlfriend’s 11-year-old daughter which resulted in her becoming pregnant.

Ruben Maciel, 42, will be required to register as a sex offender upon his release. He was found guilty of 18 counts of lewd conduct with a child under 14 years of age, including an enhancement for causing great bodily injury, reports The Californian.

Maciel had been in the child’s life since she was 4 years old but the sexual abuse only escalated last year.

The girl’s biological mother, Claudia Ochoa, helped Maciel rape her daughter by encouraging she have sex with him, according to prosecutors.

Maciel later told the girl she would get cancer if she did not have sex with him. He also told Ochoa to perform lewd acts on the child during the sexual assaults. The child was also sexually assaulted without Ochoa present on numerous occasions over a three-month period.

The sexual abuse was made known when Child Protective Services told the Monterey County Sheriff’s Office that an 11-year-old’s mother, Ochoa, had scheduled her to have an abortion. The child originally lied and said that she became pregnant by a 12-year-old boy who was new to the area. She later revealed to her stepmother that Marciel was responsible for her pregnancy.

A DNA test confirmed Maciel to be the father of the unborn baby.

In court, Maciel said he knew what he did was wrong and that he is sorry, reports KSBW.

"It's horrifying. The thought of a parent that would not only allow, but participate, in this type of abuse,” Prosecutor Jeannine Pacione said.

Ochoa was sentenced earlier this year to 16 years in prison for committing lewd acts against her own daughter.

Maciel will not be eligible for parole until he has served 30 years.
