Man Sues Burger King After An Employee Reportedly Attacked Him With A Switchblade, Taser (Video)

A New Mexico man is suing Burger King after he says a restaurant manager attacked him with a Taser and a switchblade when he asked him to reheat his cold onion rings.

Robert DeYapp claims he walked into the Bloomfield restaurant on June 7, 2013.

When he asked for warmer food, DeYapp allegedly overheard the manager, Francisco Berrera, telling another employee in Spanish that he planned to do “whatever" he wants to his food.

"This white boy is mad about his food, and he doesn't even know that I'm going to return it and do whatever I want to it and he'll still eat it and never have any idea of what I did to his food,” the complaint said.

That’s when DeYapp, who is fluent in Spanish, refused the food and said he wanted a refund.

According to the lawsuit filed Oct. 1, Berrera refused to give him a refund. The plaintiff claims Berrera lunged at him with a Taser in one hand and a switchblade in the other. Berrera was arrested and charged with aggravated battery with a deadly weapon, KRQE-TV reported. He pleaded guilty to the charge.

According to the complaint, Barrera had a history of violence with Burger King customers and coworkers.

DeYapp seeks punitive damages for assault and negligent hiring and training.
