Gun owner Jose Martinez was arrested on Wednesday after he fired bullets at suspected Walmart shoplifter Eddie McKee because he wanted to “mark” McKee’s car for police (video below).

According to WKMG-TV,  the unarmed McKee allegedly ran from an Orange City, Florida, Walmart store with stolen goods, when Martinez pulled out his gun and fired at least five bullets, which hit McKee’s vehicle and two other cars.

Martinez told WKMG-TV that he was shocked that police arrested him because he was in danger and wanted to mark the man’s car for police.

Orange City police said the surveillance video showed that Martinez was never in danger because McKee was fleeing when the shooting happened.

Martinez has a permit to carry a concealed weapon in Florida, but was charged with aggravated assault and shooting into an occupied vehicle - both felonies.

McKee was charged with a misdemeanor after police caught him in DeLand, Florida.
