John Spooner, 76, is on trial this week in Milwaukee, Wis., for allegedly shooting and killing his 13-year-old neighbor Darius Simmons on May 31, 2012.
Spooner claimed that Simmons had stolen $3,000 worth of shotguns, which the teen denied.
On a home surveillance video (below), shown in the courtroom today, Spooner points a pistol at the teen and then at the boy’s mother as she watches from the porch.
According to the Milwaukee Wisconsin Journal Sentinel, Spooner points the gun back at Simmons’ chest and fires. Simmons runs a short distance before falling and dying.

Simmons’ mother, Patricia Larry, testified that Spooner told her to call 911 and that he was going to teach the boy a lesson for stealing, reported the Associated Press.
Spooner reportedly admitted to police that he shot the teen, but said that he was at a breaking point after having a lung removed, losing his wife, being beaten and burglarized.
The defense will likely claim that Spooner had a mental illness and did not know right from wrong at the time of the shooting. His lawyer claims the senior did not mean to kill Simmons, even though he pointed a loaded gun at the teen.
