A 74-year-old man from Southgate, Michigan, shot and killed an armed intruder who reportedly broke into his house through a back window the morning of Thursday, Jan. 29.

The suspect reportedly appeared from one of the rooms with his gun aimed at the victim just as the elderly man was walking to his bedroom to call police, reports the Detroit Free Press. But the homeowner, who had a legal handgun, reportedly shot the suspect first, killing him at the scene.

The homeowner and his wife were in bed at the time of the home invasion, according to police. Police say they woke up when they heard a noise, reports The Detroit News.

The shooting reportedly took place in the living room, where a window and sliding glass door were open.

“It’s the prosecutor that gets to decide if they believe it to be justified,” said Thomas Coombs, Director of Public Safety. “Based on the information we know presently they would find it was a justified shooting. He was protecting his life.”

Police have not released the names of the suspect or homeowners and are continuing to investigate.
