David Jones Sues OKC Thunder for that One Time a Fan Fell on Him
TULSA (CN) - A basketball fan sued the Oklahoma City Thunder, claiming another fan fell out of the balcony onto him.
David Jones, of Tulsa, sued The Professional Basketball Club LLC, the City of Tulsa, Tulsa Public Facilities Authority and arena manager SMG, in Tulsa County Court.
Jones claims he attended the Thunder's preseason game against the Memphis Grizzlies at the Bank of Oklahoma Center on Oct. 12, 2101.
The Thunder usually play home games at Chesapeake Energy Arena in Oklahoma City, but play some preseason games in Tulsa.
"As the plaintiff was sitting in a seat in the BOK Center for which he had paid[,] an individual from the balcony level above the plaintiff fell out of the balcony on to the plaintiff, causing him injuries," the complaint states.
Jones does not describe his injuries, but says he "has experienced great pain and suffering and has incurred medical bills for medical treatment and lost wages."
Opened in 2008, the BOK Center lacks a major league tenant. It is home for the WNBA's Tulsa Shock and the Central Hockey League's Tulsa Oilers, according to its website.
The Thunder will host the Phoenix Suns at BOK Center on Thursday.
Jones seeks damages for negligence. He is represented by Keith McArtor of Tulsa.
