Carlos Smith, a convicted felon, was arrested and charged with felony cruelty to animals and robbery after his ex-girlfriend accused him of slamming the head of her 5-month-old Pir Bull puppy into the ground on Sunday night and then robbing her, according to the Daytona Beach News-Journal.
Sharon Aponte, 21, claims in a signed affidavit that Smith, 23, approached her car when she came home on Sunday at about 10:40 p.m. Aponte lives in the 600 block of Jean Street in Daytona Beach, Florida. She told police that Smith grabbed her 5-month-old Pit Bull puppy and began to pull on its collar to try to choke the dog, and he told Aponte to “stop playing with him [Smith].”
She described to Daytona Police how Smith then lifted the dog off the ground by its collar, spun it around, flipped it over and slammed the yelping creature to the ground on its head. She told him the dog was in pain, and she grabbed the pup and tried to push Smith away, according to the News-Journal report.
At that point, the affidavit states, Smith took $140 from her pockets and punched her in the face.
Daytona Police wrote in their report that Aponte’s dog did not seem to have visible wounds nor react as if its head was injured at that time. However, apparently there was enough evidence to convince the officers that there had been harm or trauma to the puppy, because Smith was charged with robbery and felony cruelty to animals, according to the report.
Carlos Smith was currently out on bail on charges of possession of a firearm by a convicted felon, introducing a contraband into a facility and possession of cocaine. He bailed out of the Volusia County Branch Jail shortly after midnight Wednesday, a booking officer said. The News-Journal stated it was unable to locate Smith for comment.
