Map: Where is it Legal to Own Gun Silencer in U.S.?

AWC, a silencer manufacture had a nice map of where it is currently legal to own.

Silencers are legal for civilian ownership in the following states Alabama, Alaska, Arizona, Arkansas, Colorado, Connecticut, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Maine, Maryland, Mississippi, Missouri (C&R Required), Montana, Nebraska, Nevada, New Hampshire, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, Washington, West Virginia, Wisconsin and Wyoming.

Civilian ownership is prohibited in the District of Columbia and the following states: California, Delaware, Hawaii, Illinois, Iowa, Massachusetts, Michigan, Minnesota, New Jersey, New York, Rhode Island and Vermont.

Should be Legal in all States

Because of the strict federal requirements to own a suppressor, any citizen who follows these requirements should be permitted to own one. State law should never trump Federal law. We have enough hoops to jump thru as it is.

Wrong!

Due to the fact that the Supreme Court erred in Wickard v. Filburn, the Commerce Clause has been extended to include almost everything under the sun. If we then allow Federal law to trump state law, we grant unlimited power over every item that has ever moved in interstate commerce, or which might conceivably compete with products that move in interstate commerce, to the Feds.

Conversely, the Second Amendment, properly interpreted, would BAR all virtually federal regulation of arms - including silencers. It's the NFA 1934, the GCA 1968 and the BATFE which are UNCONSTITUTIONAL. The first two clearly infringe the right to bear arms. The latter is not provided for in the Constitution, and so is unconstitutional. With regard to the Bill of Rights, those amendments incorporated against the states trump state law - though the process of "incorporation" being entirely in Federal hands, is itself suspect.

Bottom line: The Federal Government has no legitimate power to infringe the right of the People to keep and bear arms. If the Feds tell me what kind of arms I can own, where I can carry them or how - they are beyond their legitimate power. Whether states have this authority (legitimately) is dependent on the legitimacy of the incorporation process.

It is legal to own a suppressor here. It is a class C felony to put it on a firearm as it is then considered a destructive device. I was a gunsmith here, and did a lot of inquiries to find that out first.

Wow, a class c felony-they never tell you that part, how can they allow you to purchase it-it's like you could buy cigarettes but smoking is illegal....I'm finished with this state. Not done, just finished.

The writer

makes it sound like any civilian can just go to a gun store and buy one. That is not the case, at least in my state and they are one of the most lenient. Getting the gun is one thing, getting the silencer is another.

Prohibited in Connecticut

Possession of a silencer in Connecticut is a Class D felony. Here's the link to the CT state statute prohibiting it:

WRONG

The ownership of suppressors by private citizens in Connecticut is PERFECTLY LEGAL.

As long as you comply with the federal registration requirements and get a tax stamp from the ATF you are allowed under subsection (b) of Connecticut Gen statues sec 53a

I know because I own about 20 of them and have bought and sold them since the early 80's

MISCELLANEOUS OFFENSES
Sec. 53a-211. Possession of a sawed-off shotgun or silencer: Class D felony. (a) A person is guilty of possession of a sawed-off shotgun or a silencer when he owns, controls or possesses any sawed-off shotgun that has a barrel of less than eighteen inches or an overall length of less than twenty-six inches or when he owns, controls or possesses any silencer designed to muffle the noise of a firearm during discharge.

(b) The provisions of this section shall not apply to persons, firms, corporations or museums licensed or otherwise permitted by federal or state law to possess, control or own sawed-off shotguns or silencers.
