Dine-And-Dash Leads To Child Porn Arrest

A Boulder, Colorado, man was arrested on March 10 after leaving his cell phone behind while executing a dine-and-dash, and police subsequently discovered child porn on the device.

Bryan Elrod was arrested on suspicion of 13 counts of sexual exploitation of a child with possession of more than 20 images. The arrest was made after police were called to Old Chicago restaurant regarding a customer who left without paying his $37.81 bill.

When the manager of the restaurant opened the phone to identify the owner, an Internet browser was open to a site containing child pornography. Police seized the phone and determined that 42-year-old Elrod was the owner. His browser history showed that "the majority of the websites visited were for pornography," many of which contained child pornography.

There were also an additional 8,000 images saved to Elrod's phone that contained pornographic situations, and 267 of them were "obviously sexually explicit photographs of children" ranging from toddlers to early teens, Daily Camera reported.

"The mere possession of this kind of a photograph is itself a felony if somebody’s convicted," Boulder County district attorney Stan Garnett told KCNC.

Elrod reportedly has a long history of criminal activity, and was on parole at the time of the bust.

His parole officer, who helped police locate him at a motel, had become concerned for him because he hadn't yet gotten a job since being released from jail and was spending "most of his time drinking."

A warrant was issued for the man's arrest and subsequently executed. The warrant indicates he will not be allowed contact with anyone younger than 18 if released on bond.

Elrod, whose past history includes charges of fraud, theft, forgery, reckless endangerment, assault, DUI, escape from custody, shoplifting and probation violations, was jailed on $25,000 bond.

Possession of child pornography, Garnett said, is a serious crime. He expects to formally charge Elrod in a hearing on March 15.

"It also can be indicative of some significant sexual dysfunction and danger of a person possibly acting out in other ways," he added.
