Arizona's Anti-Obama Birther Bill Violates U.S. Constitution

Republicans in the Arizona state senate have passed a birther bill that would set a new requirement for a presidential candidate to get on the Arizona presidential ballot in 2012. It must go to the other branch of their legislature for final passage before the governor of Arizona can sign it.

The bill, of course, is motivated by the widespread belief that President Obama is a secret Muslim Kenyan out to impose worshiping zombies, or something like that. The bill would require a copy of the original birth certificate.

The Senate bill has an amendment that allows for other documents such as baptism records, but won't allow the short-form document. First of all, why is a baptism record more official than the birth certificate issued from the state of Hawaii? But many Republicans in Arizona don't want anything else to be used other than the long form, though the birth certificate that President Obama has is the form that the state of Hawaii sends out. It meets all the legal requirements, for example, to get a passport.

In effect, Arizona is setting a higher standard than the U.S. government for proving citizenship. Heck, Obama received a U.S. passport so his birth certificate was definitely considered good enough for the government.

Also, is the requirement for those running for the U.S. Senate or other elected positions in Arizona the same as those who are running for president? According to the law, the requirement for even vice president is not as high as president. Why only resort the presidency to this standard if it is not about getting Obama?

I must also mention that there is the Full Faith and Credit clause of the Constitution. It simply means that states have to honor what other states do in such things as marriages or drivers licenses or contracts.

Although, states have been allowed to violate this by not recognizing same sex marriages issued in states such as Massachusetts or Iowa. Hawaii issued a birth certificate and Arizona according to this clause in our Constitution, is obligated to honor it as it has done since Hawaii became a state. Until now, it seems. Obama probably won't win Arizona in the presidential election but states should not be able to violate our Constitution in the process.

Lastly, if the birthers won't believe that the short form proves Obama is a U.S. citizen, is there any reason whatsoever to believe that they would accept a long-form version as proof? Maybe legally in Arizona they would have to -- under this law -- but how long before the next version requires testing of the ink on a birth certificate to show that it matches ink used at the time of the birth? This would just go on forever.

Jerome: Obviously you are new to debate or you think everyone else is just stupid. You need realize, let it sink in, we are talking about the highest office of the land.There are no limits when it comes to making sure a person is qualfied to run for office. What is being asked is that real proof be used to qualify. If that means the long for birth certificate then that standard would be applied to everyone. Of course we know your realize that the "SIGNED" certificate has been refuse to be shown. Put aside your racism and stop trying to argue that qualification/proof used for other issues like passports should be just as good to prove qualified to run for President of the US. The great lengths you people go to to hide documents just further indicates there is certainly something to hide. I for one would post my BC in every newspaper just to show others they are wrong. But then again there is Obama..........

Yet we are talking about the most minor of possible points. Since the Presidents mother is a US Citizen her son is thusly a US Citizen. Further the short form already shows that the President was born in the USA... thus, even by the strictest of standards, he meets the Citizenship requirement.

Orly Taitz has a point. No matter anyones personal views, it is very odd that a 1961 BC would use the word "African" instead of "Negro. In the 60's, the US was a very different place. Think back to the civil rights movements and how blacks were treated many times. I am being completely unbiased when I say there is NO WAY a black person would have been called an African! Obama has just fueled the fire.........

Except that Obama Sr. was an African... as in he was literally from Africa. So what would be odd about his putting African down when filling out the paperwork?

Also it does not matter what his fathers race is as there is no racial requirement for the office of president.

You don't seem to understand. Where his father was born makes no difference. A census from 1960 and the only options are white, Asian or Negro. That would also apply to his father.
The smoking gun is and shall remain the fact that Obama spent millions to prevent others from seeing his long form BC. any one with simple logic abilities must admit something is not right here.
There are no limits that anti americans will go to take over the US. If you think that faking a BC is no pissible you have not seen anything yet.

Yet the form is not a census form... it is a birth certificate.

Also, the President did not spend millions preventing others from seeing his BC.

How exactly does this lead to "anti-Americans taking over the country... and if they could forge a BC why would they need to hide it?

Ironically, even here in AZ, when you go to get a certified copy of your birth certificate (which I have had to do for both my child and my grandchild), what you get is....wait for it...A certified Certificate of Live Birth! No doctor's name, no witness name. Simply name, date of birth, place of birth, hospital name, and parents' names, birthdates, and places of birth. Soooo, if you have one of these, you can prove citizenship for everything from eligibilty for public benefits to obtaining a US passport. However, you won't be able to run for POTUS as your Certificate of Live Birth is not a "long form" birth cerificate and doesn't have the name of the doctor who delivered you or a witness.
